Terms of Use

1. Purpose

BoothPass is a comprehensive event platform offering: matchmaking between organizers and professional DJs, an online ticketing service, an event staff recruitment module (servers, security, hosts, bartenders), and a directory of event agencies. These Terms of Use govern the use of the platform accessible at boothpass.live and its subdomains.

2. Registration and account

Access to features requires creating an account via Google OAuth or magic link (email). You are responsible for the confidentiality of your account. BoothPass reserves the right to suspend any account in the event of fraudulent use, non-compliance with these Terms of Use, or behaviour harmful to the community.

3. Roles and access

The platform distinguishes several roles: User (basic access), Organizer (event creation and publication, access to ticketing tools — subject to subscription), DJ (public profile, booking management), Staff (staff profile, applications), Agency (agency profile, request and package management), and Administrator. Each role is subject to specific terms of use and, for some, service fees.

4. Booking DJs / artists

Booking requests constitute a quote request, not a firm order. The contract is concluded only when the DJ confirms the request. BoothPass acts as an intermediary and is not a party to the contract between the organizer and the DJ. A 30% deposit is required upon confirmation; the balance is released after mutual verification on the day of the event.

5. Event Staff

Staff listings published by organizers and applications submitted by staff members constitute connections facilitated by BoothPass. BoothPass is not the employer of staff members and is not a party to the service contracts concluded between organizers and selected candidates. Each party is responsible for complying with applicable labour law.

6. Event Agencies

Agencies registered on BoothPass are independent businesses. BoothPass verifies the legal existence of agencies (business number, insurance) but does not guarantee the quality of services. Requests transmitted to agencies constitute quote requests; the service contract is concluded directly between the organizer and the agency. BoothPass receives a commission on transactions finalized through the platform.

7. Ticketing

The purchase of a ticket is final subject to the refund policy below. Tickets are personal and non-transferable without prior agreement. BoothPass issues a unique QR code per ticket, valid once at the event entrance.

8. Pricing and payment

Prices displayed are tax-inclusive in the currency of the selected region (CAD, EUR, GBP, CHF). Payments are processed by Stripe, a PCI-DSS certified secure payment service provider. BoothPass does not store any bank card data. Service fees apply depending on the transaction type (DJ bookings: 9%, agencies: 8% (Pro 5%)).

9. Refund policy

A full refund is possible within 48 hours of purchasing a ticket, as long as the event has not yet taken place. After this period or after the event, no refund will be granted except in the event of cancellation by the organizer. Service fees are non-refundable.

10. Provider no-show and liquidated damages

A provider who accepts a booking undertakes to perform on the agreed date, time and place. An unjustified absence on the day of the event causes the organiser a loss exceeding the amount paid: an event is prepared, promoted, and cannot be replayed.

Where a no-show is established, the organiser is refunded in full, service fees included. That refund does not constitute compensation for the loss suffered.

The parties further agree, by way of a penalty clause under article 5.88 of the Belgian Civil Code, that the defaulting provider shall owe the organiser liquidated damages equal to thirty per cent (30 %) of the booking amount, capped at two hundred and fifty euros (EUR 250). These damages are due as of right, without prior formal notice, in addition to the refund. BoothPass deducts them from sums owed to the provider or, failing that, claims them directly. The provider may be released by establishing force majeure under article 5.226 of the same Code — in particular hospitalisation or the death of a close relative — upon production of supporting evidence. The organiser may waive these damages.

A no-show is established after a two working-day objection period following the event, during which the provider may submit observations. Absent objection, the no-show is deemed established.

Repeated no-shows lead to temporary and then permanent suspension of access, under article 11.

11. Suspension and exclusion

BoothPass may suspend an account for breach of these terms, including: false statements on registration, non-payment, repeated payment disputes, misleading listings, repeated failures to perform accepted bookings, or any conduct impairing the proper operation of the service.

Suspension closes access to the account and removes the profile from the directories. It does not cancel tickets already purchased by the suspended person: those bind them to the organiser of the relevant event, not to BoothPass. Pending payouts are withheld pending review.

In the event of serious misconduct affecting the safety or dignity of others — violence, threats, harassment, discriminatory conduct, possession of prohibited items — BoothPass may impose an exclusion. Exclusion entails, in addition to the effects of suspension, the cancellation and refund of tickets held for future events and refusal of entry to those events. The organisers concerned are informed so that they can ensure the safety of their audience. Tickets for events that have already taken place are unaffected.

Exclusion is notified in writing with reasons. The person concerned may challenge it at support@boothpass.live within fourteen days. A challenge does not suspend the measure where the safety of persons is at stake.

Organisers retain their own right of admission and may refuse entry to their event independently of any BoothPass decision.

12. Liability

BoothPass disclaims all liability regarding the content of profiles (DJs, staff, agencies), the quality of services or the organization of events. In the event of event cancellation, the organizer is solely responsible for refunding sold tickets and engaged service providers.

13. Intellectual property

The content of the platform (design, code, texts, logo) is the exclusive property of BoothPass. Users (DJs, organizers, agencies, staff) retain ownership of their content (photos, descriptions, mixes) and grant BoothPass a non-exclusive, worldwide, royalty-free display licence for the duration of the contractual relationship.

14. Applicable law

These Terms of Use are governed by Canadian law (province of Quebec) for Canadian users, and by French law for European users. Any dispute shall be submitted to the competent courts of Montreal (Canada) or Paris (France) depending on the region.
